SESSION CONTRACT

WAIVER OF LIABILITY RELEASE. By agreeing to a photography session with Yukari Powers Photography, I am hereby waiving, releasing, and discharging Yukari Powers and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. Yukari Powers Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children their property and for themselves and release photographer from any claims against their person or their business. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Yukari Powers or Yukari Powers Photography for any reason. Yukari Powers Photography is not responsible for uncooperative parties. It is understood that the behavior of children and/or pets is unpredictable, however, photographer is not liable if children and/or pets do not cooperate during sessions.

COPYRIGHT. All photographs taken by Yukari Powers Photography are copyright protected. It is a violation of federal copyright law to alter or reproduce work created by Yukari Powers Photography. This includes but not limited to cropping, applying additional editing past the photographer’s digression, coping for digital or print, or using in advertisement without permission of Yukari Powers Photography. Yukari Powers Photography reserves all rights to all negatives, raw files, and finished images. Yukari Powers Photography will offer limited copyright release to paid customers. Sharing images online and/or on social media is allowed when credit to Yukari Powers Photography is properly given. When sharing images, images must be presented as originally delivered to the client; this means no additional editing or “filters” may be used on the image.

CREATIVE LICENSE. Images taken by Yukari Powers Photography are edited at their discretion. Delivered proofs may not include all captured photographs. Yukari Powers Photography reserves the right to edit and release only those images deemed creditable as professional in quality and within the Yukari Powers Photography’s artistic standard. Client(s) may request editing that may be done if possible to complete.

INVESTMENT.Session prices established by Yukari Powers Photography are final. A retainer($50) is required to book all sessions. Retainers are non-refundable and non-transferable. The remaining balance for the session is required at the start of the session. For sessions that take place over multiple dates and times, the total investment is required at the first of the sessions. Print investments ordered through Yukari Powers Photography are required to be paid at the time the order is placed. Preferred payments are cash or check. Please ask about Credit Card payment.

EXPENSES. Yukari Powers Photography has the right to charge for any fees or expenses that may occur during a session. This can include but not limited to admissions into locations, travel accommodations, special requests of client, etc. Mileage expenses are incurred for trips 90 miles outside of Vancouver WA, at a rate of 50₵ per mile. Mileage is charged round-trip.

CONTRACT. A signed contract is required to book a session or package. Contracts will outline session information, client information, and payment information. In the event that the client needs to make changes to the contract in terms of locations, date, or time, immediate contact with Yukari Powers Photography is required. Yukari Powers Photography will make the appropriate changes if available.

MODEL RELEASE. Yukari Powers Photography holds ownership of any images they have produced and have the right to use them in their portfolio, in promotion, and in advertisement in various forms of mediums. Mediums may include print, website, blog, and social media. Yukari Powers Photography strongly believes in respecting the rights and privacy of their client(s) and client(s) may choose how much exposure their photographs receive. A separate model release will be provided to clients which will allow the client to specify when, how, and if their photographs may be used per request per request.

MINOR CLIENT(S). In the event that a client is under the age of eighteen, a parent or guardian is required to sign the contract and model release along with them. All minors are also required to be accompanied by a parent or guardian during the session.

PET(s). A model release and contract for all pets is required to be signed by the owner who is over the age of eighteen.

SPECIAL PHOTO REQUESTS. Yukari Powers Photography is willing to entertain any special requests of images that you have however, Yukari Powers Photography is not responsible if an image in unobtainable due the unwillingness of the session participants (including pets), unfavorable weather conditions, the unavailability of desired locations, etc.

IMAGE PROOFING. All sessions will be delivered to the client by an online viewing gallery. A gallery ID and optional password will be provided to the client once the session is ready for viewing. The online viewing gallery will expire after 2 years and clients may download their full resolution portraits 1 time. If a client would like a DVD of their portraits or a USB flash drive, one can be provided for an extra fee.

PRINTING SERVICES. Yukari Powers Photography has tested several professional printing labs and has chosen a select few labs to trust with clients’ orders. All images are printed on professional grade paper with the best quality inks. Once the session is ready for viewing, the client will receive printing information sent to their email. Print ordering will also be available online in the client’s viewing gallery.

TURNAROUND TIMES. Delivery of all products included or ordered will be delivered to the client in timely matter. Yukari Powers Photography promises to have finished images from portrait sessions delivered in three weeks or less. All print orders are expected for delivery five-ten business days from the date ordered.

CANCELATION & RESCHEDULING. In the event that you need to reschedule due to sickness, injury, or other unforeseen events, please contact Yukari Powers Photography as soon as possible and your session will be rescheduled at the next available time. Respectfully, Yukari Powers Photography also reserves the right to reschedule a session due to sickness, injury, or other unforeseen events beyond one’s control. In this event, Yukari Powers Photography will notify client(s) immediately and reschedule at the next earliest availability. In the event that you cancel and do not reschedule your session, your retainer is non-refundable and non-transferable. In case of inclement weather, either party has the right to reschedule based on their own digression.

TARDINESS. The session time outlined in your contract indicates the time the session is to start. If for some reason you are running late, please contact Yukari Powers Photography as soon as possible so they are aware. Client(s) tardiness is taken out of their session time. If client(s) do not contact Yukari Powers Photography by fifteen minutes after the session was indicated to start, Yukari Powers Photography has the right to cancel the session and the client(s) will forgo their retainer. In the event that Yukari Powers Photography is running late, Yukari Powers Photography must contact the client(s) as soon as possible. Tardiness by Yukari Powers Photography will not cut into the client(s) scheduled session time. If the delay is a hindrance to the client(s), compensation will be offered.

RETURNED CHECKS. Returned checks are subject to a $50 returned check fee. Client(s) will be responsible for any and all collection costs and legal fees incurred by Yukari Powers Photography.

TECHNOLOGICAL FAILURE. In the event of camera malfunction, memory card obstruction, or a hard drive crash resulting in lost images, Yukari Powers Photography will provide compensations for the inconvenience by providing another session or full refund. Yukari Powers Photography promises to have a back-up camera, lenses, and memory cards in case an issue shall arise.

REFUNDS. Yukari Powers Photography may deny the request for a refund if the request is based off photographic style differences as it is the client’s responsibility to choose a photographer that matches their style and quality expectations.

ARCHAVIAL RECOVERY. In the event that a client needs their images recovered from Yukari Pwoers Photography’s archive, there will be a fee of $50. Sessions are moved to the archive after two year.
